Leegin Decided: Dr. Miles Overruled

The Supreme Court in a 5-4 decision written by Justice Kennedy today overruled the 1911 decision making resale-price maintenance per se illegal under Section 1 of the Sherman Act. Find the opinion here.

    This Opinion seems to accomplish the privatization of price control regulations. It seems odd to me that “free market” folks who applud this decision are in effect supporting a less free market by allowing private enterprise to restrict retail price competition.
