- Reminder: Intel’s “subject matter jurisdiction motion—often referred to as an Empagran—which questions whether U. S. law applies to the case, and thus whether a U.S. court has jurisdiction to try it” in the AMD-Intel case will be filled tomorrow. (If someone is kind enough to email it to us, we will post it).

Hey, where were you guys when f/k/a talked about Sports Law Blog [it’s not called a “Blawg”, thank goodness] in baseball: intestate commerce (stare decisis on steroids?) (Dec. 8, 2004) and antitrusters question NCAA purchase of NIT (Sept. 13, 2005)?
Talk about new guys on the block.

According to MarketWatch, “claims AMD cannot apply U.S. antitrust laws to alleged harms that supposedly occurred overseas. ‘To a large extend, AMD seeks recovery under U.S. antitrust law for lost sales of its foreign-made processors to foreign companies in foreign locations,’ Intel’s attorneys wrote in court papers.
