What’s The Big Secret?

I must admit that while I live and work in Washington, D.C. (and went to law school here), I still do not understand how many interest groups operate.  I was/am working on a post that would contain links to some of the amicus briefs that were filed this week in Leegin.  As previously noted, the United States’s brief is online.  CITA-The Wireless Association and the American Petroleum Institute have also filed amicus briefs on the merits (CITA also filed a brief supporting Leegin’s petition for certiorari).  But neither CITA nor API has posted their brief on their website (nor has CITA posted its amicus brief supporting the petition for cert.).

Why not?  I do not understand this.  They are public advocacy groups.  The briefs are public documents.  A pdf copy CITA’s brief was even sent out on an ABA listserve this week.  The National Association of Manufacturers filed an amicus brief supporting Leegin’s petition for certiorari and it is on NAM’s website.  So come on CITA and API, post your briefs online!

Have you read Ping Golf’s brief. I think it is the best and simplest to understand.

I have. Ping Inc.’s brief describes its recently adopted vertical minimum resale advertising and pricing policy (its “iFIT Pricing Policy”) and the “extraordinary lengths” it went through in order to achieve a minimum resale price that complies with Colgate and avoids Dr. Miles’s per se rule.
