Leegin Coverage in Newspapers and in Blogs

Several newspaper covered the oral arguments yesterday, including, the New York Times, the Washington Post, the LA Times and USA Today.  The WSJ Law Blog highlighted Scalia’s consumer welfare questions; Mark Thoma at Economist’s View highlighted the economics portions of the transcript; and Shubha Ghosh at the Antitrust & Competition Policy Blog predicts Kennedy is the swing vote.

[Update: Josh Wright at Truth on the Market also has some initial thoughts and predicts a "7-2 or 6-3 [decision].  Something like that.”

Further Update: Thom Lambert, also at Truth on the Market, highlights an interesting rhetorical question from Justice Breyer.

Finally, I’ll join in the prediction game with a prediction that the Court will, by a 6-3 vote, overturn Dr. Miles.  The Majority will be Chief Justice Roberts, and Justices Scalia, Thomas, Kennedy, Alito and Ginsberg.  Ginsburg joins the majority thanks to a footnote that provides PKSK with some leeway on remand (almost all of her questions involved the facts of the case and her other major concern, raised twice, was with Congressional support for Dr. Miles).]
